Welcome to Boo! Customization. The terms “we”, “us” and “our” refer to Boo! Customization, a sole proprietorship operating from Bengaluru, Karnataka, India.

Boo! Customization operates this website and online store, including all related information, content, features, tools, products and services (collectively, the “Services”) to provide you, the customer, with a curated shopping experience. Boo! Customization is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (“Terms”), together with any policies referenced herein, describe your rights and responsibilities when you access or use our Services.

By visiting, interacting with, or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use or access the Services.

SECTION 1 – ACCESS AND ACCOUNT

You must be at least 18 years of age to use the Services. By using the Services, you represent that you are legally capable of entering into a binding contract under Indian law.

To access certain Services or place orders, you may be required to provide personal information including your email address, billing details, payment information, and shipping address. You represent that all information provided is accurate, current, and complete.

You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Accounts may not be transferred, sold, or assigned to any other person.

SECTION 2 – OUR PRODUCTS

We offer both ready-made/standard products and fully customized or personalized products.

We make reasonable efforts to accurately display product details, colors, and designs. However, actual appearance may vary due to screen settings, lighting, or device differences. We do not guarantee that product appearance will exactly match on-screen representations.

Product descriptions, pricing, and availability are subject to change without notice. We reserve the right to discontinue any product or limit quantities at our discretion.

SECTION 3 – CUSTOMIZED PRODUCTS (IMPORTANT)

Customized or personalized products are created based on information, content, and approvals provided by the customer.

Customers are responsible for reviewing and approving mockups, previews, spelling, design, names, images, and all customization details before production.
Once production has started, customized products are not eligible for return or refund, except where Boo! Customization is clearly at fault.
Boo! Customization is not responsible for errors approved by the customer, including spelling mistakes, design choices, or incorrect information provided by the customer.

SECTION 4 – ORDERS

Placing an order constitutes an offer to purchase. We reserve the right to accept or reject any order at our discretion. An order is considered accepted only after payment is successfully processed and confirmation is issued.

Please review orders carefully before submission. Cancellation requests may not be accommodated once production or processing has begun.

Returns or refunds are governed solely by our Refund Policy, which forms part of these Terms.

All purchases are for personal use only and not for resale or commercial distribution.

SECTION 5 – PRICES AND BILLING

All prices are subject to change without notice. Prices displayed at checkout exclude shipping, customs duties, or international import charges unless explicitly stated.

We are not GST registered. Customers are responsible for any applicable taxes, duties, or customs fees imposed by their local authorities.

You agree to provide accurate and complete payment information and authorize us to charge your selected payment method for all applicable charges.

SECTION 6 – SHIPPING AND DELIVERY

We ship both within India and internationally.

Delivery times are estimates only and not guaranteed. We are not responsible for delays caused by shipping carriers, customs clearance, or events beyond our control.

Once the product is handed over to the shipping carrier, risk of loss and title pass to the customer.

SECTION 7 – INTELLECTUAL PROPERTY

All content on the Services, including text, graphics, images, designs, logos, and trademarks, is owned by Boo! Customization or its licensors and is protected by applicable intellectual property laws.

You may not copy, reproduce, distribute, or exploit any content without prior written permission.

Customers are responsible for ensuring that any images, logos, names, or designs they submit for customization do not infringe third-party rights. Boo! Customization is not liable for intellectual property violations arising from customer-provided content.

SECTION 8 – THIRD-PARTY TOOLS AND LINKS

The Services may include third-party tools or links. We do not control or endorse these third parties and are not responsible for their content, accuracy, or practices. Use of third-party services is at your own risk.

SECTION 9 – RELATIONSHIP WITH SHOPIFY

Boo! Customization is powered by Shopify. However, all sales and transactions are solely between you and Boo! Customization. Shopify is not responsible for any aspect of purchases made through our store.

SECTION 10 – FEEDBACK

Any feedback, reviews, suggestions, or submissions provided by you may be used by Boo! Customization without restriction, compensation, or obligation, provided such use complies with applicable law.

SECTION 11 – ERRORS AND OMISSIONS

We reserve the right to correct errors, inaccuracies, or omissions at any time and to cancel or modify orders if information is inaccurate, including after submission.

SECTION 12 – PROHIBITED USES

You agree not to misuse the Services, violate laws, infringe intellectual property rights, submit harmful or misleading content, or interfere with the security or operation of the Services.

We reserve the right to suspend or terminate access for violations of these Terms.

SECTION 13 – TERMINATION

We may terminate or restrict access to the Services at any time without notice. All obligations incurred prior to termination remain enforceable.

Nothing in these Terms limits liability that cannot be excluded under applicable Indian law.

SECTION 16 – INDEMNIFICATION

You agree to indemnify and hold harmless Boo! Customization from any claims arising from your misuse of the Services, violation of these Terms, or infringement of third-party rights.

SECTION 17 – SEVERABILITY

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

SECTION 18 – ENTIRE AGREEMENT

These Terms, together with referenced policies, constitute the entire agreement between you and Boo! Customization.

SECTION 19 – GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of India.
The courts of Bengaluru, Karnataka, India shall have exclusive jurisdiction.
